LAUSD’s MEASURE EE DEALT MAJOR SETBACK IN TAXPAYERS LAWSUIT HEARING
LOS ANGELES – In a stunning setback to the Los Angeles Unified School District’s Measure EE, Los Angeles Superior Court Judge Mary Strobel today ignored requests from a District lawyer to dismiss the Howard Jarvis Taxpayer Association’s lawsuit and instead set a hearing date for June 6, two days after Election Day to determine whether the election results should be certified.
HJTA lawyer Thomas Hiltachk, partner at Bell, McAndrews and Hiltachk, argued that the District violated the Elections Code by making multiple changes to Measure EE’s language after its language was approved by the LAUSD Board, essentially creating an illegal election. At the same time, Hiltachk argued that the District violated open meeting laws by not publicly discussing significant changes unilaterally made by Superintendent Austin Beutner.
“The judge set a hearing date after the June 4 election to determine whether in fact the election results for Measure EE should be certified,” said Matt Klink, spokesperson for the No on Measure EE campaign. “Today’s decision affirms that LAUSD may have made a number of mistakes in their rushed ballot measure. It’s impossible for voters to know what they’re voting on and how big a property tax bill they’re on the hook for.”
